Welcome to the Third Judicial District Court, Dona Ana County, New Mexico. One vital element of this court is jury service. As a juror you play a significant role in ensuring that justice is carried out fairly and impartially.
The Constitutions of the United States and the State of New Mexico guarantee the right of trial by jury. Juries may consist of six or twelve members depending on the court and type of case.
Any citizen who is qualified to vote, has a valid State of New Mexico driver’s license or who files a New Mexico personal income tax return, may be summoned for service as a juror.
If you received a summons in the mail you will need to fill out the Juror Qualification Form and the Juror Questionnaire Form. Please place the forms in the reply envelope with the court address showing in the window. After viewing the on-line video orientation, fill out and return the Juror Certification and Waiver Form.
Unless you receive an excusal card from the Court stating that you are excused from attending jury service, you MUST appear at the court on the date listed on your summons. Not showing up for jury duty, when summoned, is called Failure to Appear. The penalties include: $500 fine or up to six (6) months in jail. (NMSA 1978, 31-19-1)
It is the prospective juror’s responsibility to call the jury recording the day before he/she is scheduled to appear to see if he/she is actually needed on the scheduled day.
